Welcome to MenturaPOS, a product of Mentura Global Pvt Ltd. These Terms and Conditions ("Terms") govern your access to and use of www.menturapos.com, our software, hardware, and installation services. By using our website or purchasing our products, you agree to these Terms.

1. Our Products

MenturaPOS provides:

• Software: a cross-platform POS system available on Windows, macOS, iOS, and Android, offered through a free tier for small businesses as well as paid package and feature-based plans.
• Hardware: full POS machine bundles, and individually purchasable equipment and parts (e.g. thermal printers, barcode scanners, cash drawers, paper rollers, cables).
• Installation services: on-site setup and installation, available on request for an additional fee.

2. Eligibility & Accounts

• You must be authorized to act on behalf of the business registering for MenturaPOS.
• You are responsible for keeping your account credentials and license keys confidential.
• You agree to provide accurate business, billing, and contact information.

3. Free Tier & Paid Plans

• The free tier is provided for small businesses and may have feature or usage limits at our discretion.
• Paid plans unlock additional features/packages as described on our pricing page at time of purchase.
• We may change free tier limits or plan features with reasonable notice; existing paid subscriptions will be honored for their current billing term.

4. Orders, Pricing & Payment

• Placing an order (software plan, hardware, or parts) is an offer to purchase, which we may accept or decline (e.g. stock unavailability, pricing errors, suspected fraud).
• Prices for software plans, hardware, and individual parts are as listed on www.menturapos.com and are subject to change without notice for future orders.
• Payments are processed via our third-party payment gateway; we do not store full payment card details.

5. Hardware Sales & Parts

• We sell complete POS machine bundles as well as individual components and parts separately.
• Product descriptions and images are provided in good faith but may vary slightly from the actual item (e.g. minor packaging or revision changes).
• Compatibility of individually purchased parts (e.g. barcode readers, rollers) with third-party or older hardware is the customer's responsibility to confirm before purchase, unless purchased as part of a MenturaPOS bundle.

6. Installation Services

• Installation is optional and provided on request, at locations and times mutually agreed upon.
• Installation fees, if any, are separate from hardware and software costs and communicated at time of booking.
• Access to the installation site and any necessary permissions are the customer's responsibility.

7. Software License

• Paid and free use of MenturaPOS software is licensed, not sold. You receive a non-exclusive, non-transferable right to use the software per your selected plan.
• You may not reverse-engineer, resell, sublicense, or redistribute MenturaPOS software without our written consent.
• License keys and activations are tied to the business/account they were issued to.

8. Returns & Refunds

Our Refund Policy governs returns for hardware, parts, and software plans, and forms part of these Terms.

9. Intellectual Property

All content on www.menturapos.com, and the MenturaPOS software itself, including branding, code, design, and documentation, is the property of Mentura Global Pvt Ltd or its licensors and is protected by intellectual property law. You may not copy, modify, or redistribute it without prior written consent.

10. Warranty & Liability

• Hardware sold through MenturaPOS carries a manufacturer/supplier warranty of [X months/years], details of which are provided at purchase.
• We make reasonable efforts to keep MenturaPOS software reliable and secure, but do not guarantee uninterrupted or error-free operation.
• To the extent permitted by law, Mentura Global Pvt Ltd is not liable for indirect, incidental, or consequential damages arising from use of our software, hardware, or installation services.

11. Termination

We may suspend or terminate access to MenturaPOS software for violation of these Terms, including license misuse or non-payment of applicable fees.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or products after changes are posted constitutes acceptance of the revised Terms.
